Section 51 broadens the scope of what constitutes taxable income under industrial and commercial profits by including various activities related to real estate, leasing, and entertainment. Here’s a breakdown of these categories:

1. Real Estate and Business Property Intermediaries

Individuals acting as intermediaries in the purchase and sale of real estate or business property, or those who habitually buy and resell such properties in their own name, fall under this category.

Example:
A person buying and reselling commercial properties, earning CFAF 3,000,000 annually from these transactions, will have these profits taxed as industrial and commercial income.

2. Land Development and Sales

Profits made by individuals who parcel out and sell land they own after site development are also taxable. This includes subdividing land and selling individual plots.

Example:
A landowner who develops a large plot into smaller parcels and sells them, earning CFAF 4,500,000, will be taxed on these earnings.

3. Letting Out Furnished Business Establishments

Individuals who let out industrial or business establishments equipped with the necessary furniture and equipment for practical use, with or without including intangible assets, are subject to tax.

Example:
A business owner who leases a fully furnished workshop, generating CFAF 2,000,000 in rental income, will have this amount taxed as industrial and commercial profits.

4. Letting or Sub-letting Furnished Property

Profits from letting or sub-letting furnished properties are considered taxable. This applies to properties rented out with furniture.

Example:
An individual renting out a furnished apartment and earning CFAF 1,200,000 in rental income annually will be subject to personal income tax on these profits.

5. Operation of Games of Chance and Entertainment

Those whose main or supplementary activity involves the operation of games of chance and entertainment are included in this taxable category.

Example:
An operator of a small gaming arcade making CFAF 3,500,000 from gaming activities will be taxed on these profits.
